Costa Rica is well-known worldwide for its stable democracy and beautiful untainted beaches. Therefore, the combination of these two factors is highly attractive to foreign real estate investments. In the last few years the Costa Rica real estate market has been growing offering a wide range of options.
It is therefore no surprise that beachfront real estate in Costa Rica is actively sought by foreign developers, retirees and those looking for vacation homes. First, they are attracted by the natural beauty of the country, and second for its political stability (widely recognized as one of the most stable political systems within Latin America).
In Costa Rica, according to the 45th article of the Political Constitution, property rights are inviolable. Nevertheless, there are pieces of land that are considered National Patrimony of public domain. This means that transfers or leases on this property in Costa Rica are subject to specific legal dispositions, such as properties located within the Maritime Zone.
The Maritime Zone is a 200-meter (656 feet approximately) wide strip of land running parallel to the coastline, starting at the ordinary high-tide including rocks and terrains left by the sea in the low tide along the Pacific and Atlantic coast. This zone also includes islands, pinnacles of rock, mangroves, estuaries, small islands and any small natural formation that overcome the level of the ocean. Properties on this zone cannot be privately transferred as fee simple title. However there is a legal procedure to acquire concession rights on these parcels. These rights may be granted for a determined period of time, but subject to any of the contingencies described in the mentioned law.

Now what happens? ….and where does Costa Rica fit in?

The past few weeks have seen huge gyrations in the financial markets and major shifts in domestic policy, especially in regards to virtually “anything” connected with money and finances. This is not the forum for debate as far as “right or wrong” for the massive amounts of dollars committed to bailing out our financial institutions AND its many, many participants. BUT it does affect all of us… some of us far more than others.
Many have lost tens and hundreds of thousands of dollars in their retirement accounts… and that is on top of the billions of dollars that have disappeared in the real estate market. What happens now? Especially to those who were looking forward to retirement in Costa Rica? Is it still a possibility?
Well, let’s look at it this way… what is the alternative? Can you live out your remaining years in the States or Canada with your savings and pension or social security? Unless you make well over $3-4,000 per month, the answer is “probably not”. Medical costs alone will be a killer. And now that many have significantly less savings and equity, the potential standard of living for many is bleak indeed. Read More...
